The Stay of the Texas Abortion Law, House Bill 2, was overturned. The court that overturned it is one of the most conservative courts in the country.
The victory Texas women had over the new Texas abortion law was short lived. A few days ago Judge Lee Yeakel ruled that the provision that required doctors performing abortions to have admitting privileges in Hospitals within 30 miles were unconstitutional. He also ruled that it is unconstitutional for the state to ban a woman from having drug-induced abortions when a physician deems it appropriate.
According to the Texas Tribune,
A three-judge panel in the 5th Circuit appellate court lifted a permanent injunction placed on the abortion regulations by a lower court, arguing in a written opinion that the state was likely to succeed in its legal arguments.
The judges, Priscilla R. Owen, Jennifer Walker Elrod and Catharina Haynes, wrote that “there is a substantial likelihood that the state will prevail in its argument that Planned Parenthood failed to establish an undue burden on women seeking abortions or that the hospital-admitting-privileges requirement creates a substantial obstacle in the path of a woman seeking an abortion.” Furthermore, they wrote,”we also conclude that the state has made a strong showing of likelihood of success on the merits, at least in part, as to its appeal of the injunction pertaining to medication abortions.”
More than twelve clinics in Texas will have to close effective immediately. Some of them are far from any other available clinics.
Rachel Maddow invited Amy Hagstrom Miller to her show to discuss its impact. She is the owner of five Texas abortion clinics. She told Rachel Maddow that three of her clinics will shut down immediately. Her employees have already started calling clients to cancel appointments. She said that her border town clinics serve many underserved poor women of color. These women will likely be unable to travel the hundreds of miles to the nearest clinics.
This may seem like a victory for the GOP. It is not a victory for Greg Abbott. It will excite the Wendy Davis for Governor base. They will see yet another reason for her victory.
