The attorney for Rayshard Brooks told an important story. He proves all the reasons why it should not have escalated to the murder of a citizen by a rogue cop.

After watching the entire body cam video, it was clear that the officers did not really have an interest in anything but an arrest. They attempted to have the Mr. Brooks make incriminating statements about his sobriety.

The lack of humanity of the officers was palpable even as they cloaked in faux civility with the expectation of coercing statements they wanted out of Brooks. Brooks spoke about his daughter’s birthday and being in the area for her. They did not care. They just wanted a catch. It was a hunt for an arrest with a facade of civility.

There is a point in the body cam where brooks said he would lock up the car and either walk to his sister’s house or his hotel. That was a point of de-escalation as his attorney, Chris Stewart pointed out. An empathetic officer would have done community policing instead of allowing an escalation to murderous policing.

The wild shooting by the irresponsible police officer Garrett Rolfe sent a bullet piercing through a car in the parking lot that could have killed another family.

As both of the lawyers made clear, while it is best not to resist arrest, it is not surprising that given our times that Rayshard Brooks would attempt to flee as the officer attempted to cuff him. To him, he likely had a 50/50 chance of death either way. The murder-by-cop of George Floyd is still seared in the minds of many.
